Awaii – Terms of Use

Welcome to Awaii (“Awaii”, “the App”, “we”, “us”), operated by Gunnar Erickson. By accessing or using Awaii, you agree to these Terms of Use (“Terms”). If you do not agree, you may not use the App.

1. Eligibility

You must be at least 13 years old to use Awaii. If you are located in the European Union or EEA, you must be at least 16 years old, or have consent from a parent or legal guardian where required by law.

2. Accounts and Guest Use

2.1 Registered Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and up-to-date information.

2.2 Guest Mode

Awaii may allow limited use without creating an account (“Guest Mode”). Guest access may be restricted and data may be removed after a period of inactivity. Guest data can be linked to a full account if you choose to register.

3. Use of the App

You agree to use Awaii only for lawful purposes and in a manner that does not harm the App, its users, or its infrastructure.

Prohibited activities include:

  • Uploading illegal, abusive, or harmful content
  • Attempting to bypass security, access controls, or usage limits
  • Reverse-engineering, modifying, or redistributing the App
  • Using Awaii for unauthorized commercial purposes
  • Scraping or harvesting data from the App

4. User Content

You may upload or create content such as trips, notes, locations, photos, and other materials (“User Content”). You retain ownership of your User Content.

By using Awaii, you grant us a limited, non-exclusive, worldwide license to store, process, and display your User Content solely for the purpose of operating the App and enabling collaboration features.

You are responsible for ensuring that your User Content does not violate any laws or third-party rights.

5. Collaboration and Sharing

Awaii allows you to collaborate with others and share access via invitations or join links. You are responsible for whom you invite and the access you grant.

Join links are secured and may include expiration or usage limits. We are not responsible for access granted through links you share.

6. Paid Features

Awaii may offer paid features or one-time purchases. Pricing, billing, and refunds are handled through the App Store or other authorized platforms.

Digital purchases may be non-refundable except where required by law.

7. Third-Party Services

Awaii integrates third-party services to provide certain features, including mapping, place search, and optional cover photos. These services may include Mapbox, Google Places, and Unsplash.

Your use of third-party features may be subject to their own terms and privacy policies. We are not responsible for the content, availability, or practices of third-party services.

8. Availability and Changes

Awaii is provided on an “as-is” and “as-available” basis. We may modify, suspend, or discontinue parts of the App at any time.

We do not guarantee uninterrupted or error-free operation.

9. Termination

We may suspend or terminate your access if you violate these Terms, misuse the App, or pose a risk to other users or the platform.

You may stop using Awaii and delete your account at any time.

10. Privacy

Your use of Awaii is governed by our Privacy Policy, which explains how we collect and process personal data.

11. Disclaimer of Warranties

To the maximum extent permitted by law, Awaii is provided without warranties of any kind, whether express or implied.

12. Limitation of Liability

To the fullest extent permitted by law, Awaii and its operator shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, revenue, or business, arising from your use of the App.

13. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects the current version. Continued use of Awaii constitutes acceptance of the updated Terms.
